Who we are

Brix + Bailey is a trading name of Brix And Bailey Limited, registered in England and Wales under company number 08737866, whose registered office is at 24-25 Barnack Business Centre, Blakey Road, Salisbury, Wiltshire, SP1 2LP.

How the marketplace works, and why it matters here

Brix + Bailey is a marketplace. When you buy something, your contract is with us, and we handle your order, your payment and any returns. But the brand that made the item usually packs and posts it themselves.

That means we pass your name, delivery address and order details to the brand you bought from, so they can send you your parcel. They are contractually bound to use that information only to fulfil your order and to help resolve any query about it, and to delete it afterwards. They may not use it to market to you. If you buy from three brands, three brands receive your delivery details.

What we collect

  • Contact details: your name, email address, phone number, billing address and delivery address.
  • Order information: what you looked at, added to your basket, bought, returned or cancelled, and when.
  • Payment information: handled by our payment providers. We receive confirmation and the last four digits of a card, not the full card number.
  • Account information: your login details and saved preferences, if you create an account.
  • Messages: whatever you send us by email or chat, and our replies.
  • Reviews: anything you submit, and the name you submit it under.
  • Device and usage information: your IP address, browser, device type, how you found us, and how you move around the site.

We collect this from you directly, automatically as you use the site, and from our service providers and payment partners.

Where we rely on legitimate interests, we have considered whether that interest is outweighed by your rights, and you can object at any time using the contact details below.

Who we share it with

  • The brand you bought from, so they can send you your order. See the section above.
  • Shopify, who host and run the shop. See the section below.
  • Payment providers, who process your payment. We never see your full card details.
  • Carriers, so your parcel arrives.
  • Service providers who work on our behalf: email, analytics, customer support, fraud screening and IT. They act on our instructions and may not use your information for their own purposes.
  • Advertising and analytics partners, where you have consented through the cookie banner.
  • Professional advisers, such as our accountants and solicitors, where they need it.
  • Authorities and regulators, where the law requires it.
  • A buyer of the business, if Brix + Bailey is ever sold, along with our advisers on that sale.

We do not sell your personal information.

Our relationship with Shopify

The shop runs on Shopify, which collects and processes information about your use of it in order to provide and improve the service. Information you give us is transmitted to Shopify and may be shared with third parties in countries other than the one you live in.

We also use certain Shopify enhanced features that draw on data from your interactions with our shop, with other merchants, and with Shopify itself, in order to improve products, advertising and personalisation. For that processing, Shopify is the controller and is responsible for responding to requests about how it uses your information. You can read the Shopify Consumer Privacy Policy and use the Shopify Privacy Portal to exercise rights over it.

Cookies

We use cookies, and you control the optional ones. Our Cookie Policy explains which cookies we set, what each one does and how to change your mind.

Cookies that are strictly necessary for the basket and checkout are set automatically. Everything else waits for your consent.

Marketing

We only send marketing emails to people who have asked for them. Every one carries an unsubscribe link, and it works immediately. If you unsubscribe we will still send you messages about orders you have placed, because those are not marketing.

Where your information is held

Our Shopify data is hosted in the European Union.

Some of our service providers and some of our brands are outside the UK and the European Economic Area, so your information may be transferred to and processed in other countries. Where that happens, we rely on an adequacy decision covering the destination country, or on the UK International Data Transfer Agreement or the European Commission's Standard Contractual Clauses.

How long we keep it

  • Order and transaction records: six years after the end of the financial year they fall in, because tax law requires it.
  • Account information: for as long as your account is open, and then a reasonable period afterwards.
  • Delivery details held by a brand: deleted 30 days after your parcel is dispatched.
  • Marketing consent and email history: until you unsubscribe, and a record of the unsubscribe afterwards so we do not email you again by mistake.
  • Customer service messages: long enough to resolve the matter and to handle any complaint or claim arising from it.
  • Reviews: for as long as they are published.

Your rights

If you are in the UK or the European Economic Area you have the right to:

  • ask what we hold about you and get a copy;
  • have inaccurate information corrected;
  • ask us to delete information where there is no good reason to keep it;
  • object to processing we carry out on the basis of legitimate interests, and to direct marketing at any time;
  • ask us to restrict processing while something is checked;
  • receive information you gave us in a portable format, or have it sent to somebody else; and
  • withdraw consent at any time, which does not affect anything done before you withdrew it.

Email mail@brixbailey.com and we will respond within one month. We may need to confirm who you are first. Exercising any of these rights costs nothing and we will not treat you differently for it.

If you live in certain US states

Depending on where you live, you may also have the right to opt out of the sale or sharing of your personal information and of targeted advertising, to appeal a decision we make about a request, and to be free from discrimination for exercising these rights. Use the data sharing opt-out link in our footer, or email us.

If you visit with the Global Privacy Control signal enabled, we treat that as an opt-out request for that browser and device. We do not act on other Do Not Track signals.

Children

This shop is not intended for children, and we do not knowingly collect personal information from anyone under 13. If you are a parent or guardian and think your child has given us information, email us and we will delete it.

Security

We take reasonable technical and organisational measures to protect your information, and we require our service providers and brands to do the same. No system is perfectly secure, so please do not send us confidential information over channels that are not.

Complaints

If you are unhappy with how we have handled your information, tell us first at mail@brixbailey.com and we will try to put it right.

You also have the right to complain to the Information Commissioner's Office, the UK data protection regulator, at ico.org.uk or on 0303 123 1113. If you live in the EEA, you may complain to your national supervisory authority instead.

Changes

We will update this page when our practices change, and the date at the top tells you when we last did.
