Welcome to Brix + Bailey, a curated marketplace bringing together independent brands, designers, makers and boutiques from around the world.

These Terms and Conditions explain how purchases made through Brix + Bailey work, your rights as a customer and our responsibilities to you. Nothing in these Terms affects any rights you have under applicable consumer law.

1. Who We Are

Brix + Bailey is operated by Brix And Bailey Limited, a private limited company registered in England and Wales under company number 08737866.

Our registered office is 24-25 Barnack Business Centre, Blakey Road, Salisbury, Wiltshire, SP1 2LP, United Kingdom. You can contact us at mail@brixbailey.com.

In these Terms, "Brix + Bailey", "we", "us" and "our" mean Brix And Bailey Limited. A "Brand Partner" means an independent brand, designer, maker or boutique whose products are offered through Brix + Bailey.

2. How Brix + Bailey Works

Brix + Bailey is a curated marketplace, and many of the products available through our website are created and supplied by independent Brand Partners.

Unless we tell you otherwise before you place an order, your contract for the purchase of products through Brix + Bailey is with Brix And Bailey Limited. Your order and payment are handled by Brix + Bailey.

Products may nevertheless be held, packed and dispatched directly by the Brand Partner from its own studio, boutique, warehouse or fulfilment location. An order containing products from more than one Brand Partner may therefore arrive in separate parcels and at different times.

Whatever the fulfilment arrangement, Brix + Bailey is your point of contact for your order, payment, delivery queries, cancellations, returns and refunds. You do not need to contact a Brand Partner directly unless we specifically ask you to do so.

3. Who Can Place an Order

You must be at least 18 years old and legally capable of entering into a contract to place an order through Brix + Bailey. When you place an order, you confirm that the information you provide is accurate and complete.

4. Placing an Order

When you submit an order through our website, you are offering to purchase the products shown in your order. We will normally send you an email acknowledging that we have received your order. An order acknowledgement does not mean that your order has been accepted.

Before accepting an order, we or our service providers may check product availability, pricing, payment information and appropriate fraud and security information.

Your contract for a product is formed when we send you confirmation that the product has been accepted for fulfilment or dispatched. Where products in the same order are accepted or dispatched separately, acceptance may occur separately for each product.

5. When We May Not Accept an Order

We may be unable to accept all or part of an order if:

  • a product is unavailable
  • payment cannot be authorised
  • we identify a fraud or security concern
  • delivery is unavailable to your location
  • applicable restrictions prevent the sale
  • we discover an obvious pricing or product-information error

If we cannot accept your order, we will let you know as soon as reasonably possible. If we have already taken payment for a product we cannot supply, we will refund that payment.

6. Products and Product Information

We and our Brand Partners take reasonable care to ensure that descriptions, photographs, materials, measurements, colours and other product information displayed on Brix + Bailey are accurate. Product information may be supplied to us by the relevant Brand Partner. Colours can appear differently depending on the screen or device you use.

Some products are handmade, artisan-produced, vintage, upcycled or made using natural materials. Reasonable variations in colour, texture, finish, dimensions or pattern may therefore form part of the individual character of a product.

Nothing in this section affects your legal rights if goods are not as described, not of satisfactory quality, not fit for purpose or otherwise fail to meet applicable consumer-law requirements.

7. Availability

All products are subject to availability. Because many products come from independent brands and boutiques and may also be sold through other channels, an item can occasionally become unavailable before our systems have been updated. If this happens after you place an order, we will let you know and refund any amount you have paid for the unavailable product.

8. Prices

The price payable for a product will be shown on the website in the currency applicable to your shopping region. Prices will include applicable taxes where required by law. Mandatory charges that can reasonably be calculated will be included in, or properly reflected alongside, the total price shown.

Delivery charges may vary according to the product, Brand Partner, delivery destination and delivery method. Where a mandatory delivery charge can reasonably be calculated, we will include it in the total price in accordance with applicable law. Where it cannot reasonably be calculated until we know information such as your delivery destination, we will provide the information necessary to understand or calculate the charge and show the final amount as soon as it can reasonably be determined.

Optional services, such as expedited delivery where available, will be displayed separately and will only be added if you choose them.

9. Pricing Errors

We try to ensure that prices displayed on Brix + Bailey are correct. Occasionally an obvious pricing error may occur because of incorrect information, a technical problem or human error.

If we discover an obvious pricing error before accepting your order, we may decline the order and give you the opportunity to order the product at the correct price. If payment has already been taken for an order we do not accept, we will refund it.

10. Payment

Payment is made through the payment methods offered at checkout. Brix + Bailey collects payment for orders placed through the Brix + Bailey checkout.

Depending on the payment method, payment may be authorised or collected before the order is accepted. Taking or authorising payment does not by itself mean that we have accepted the order. If an order is subsequently not accepted, any payment collected for it will be refunded.

11. Delivery

Products may be dispatched directly by our Brand Partners. Estimated delivery information will be provided on the website, at checkout, in your order information or through subsequent delivery communications as appropriate.

Unless expressly stated otherwise, delivery dates are estimates rather than guaranteed dates. Where no different delivery period has been agreed, goods will normally be delivered without undue delay and within 30 days after the contract is entered into. If there is a material delay, we will contact you as soon as reasonably possible. Your statutory rights in relation to delayed or failed delivery are not affected.

12. Separate Parcels

Because Brand Partners may dispatch their own products, items within the same order may arrive separately. Separate parcels may have different couriers, tracking numbers and delivery dates. Where relevant, we will provide tracking information as it becomes available to us.

13. International Orders, Customs and Import Charges

Products sold through Brix + Bailey may be dispatched internationally. Depending on the destination and fulfilment location, an order may be subject to customs procedures, import duties, taxes or other charges.

Where these charges are included in the amount you pay to Brix + Bailey, we will indicate this where appropriate. Where charges are payable separately by you, we will provide the information required by applicable law before purchase where reasonably possible. You are responsible for complying with lawful import restrictions applicable in your destination country.

14. Changing Your Mind

We hope you love what you have bought, but sometimes things simply do not work out.

Brix + Bailey gives you 30 days from delivery to tell us that you would like to return an eligible product under our voluntary returns policy.

UK consumers generally have a statutory right to tell us within 14 days of receiving their goods that they wish to cancel an eligible online purchase without giving a reason. You then generally have a further 14 days to return the goods after telling us that you wish to cancel.

Our 30-day voluntary returns policy does not reduce your statutory rights. Full details are on our Returns and Refunds page.

15. How to Start a Return

To start a return, email mail@brixbailey.com within the applicable return period. Please include your name, your order number, and the item or items you would like to return.

Please wait for our return instructions before sending the product, as different Brand Partners may have different return addresses. We will tell you where the product needs to be sent.

16. Condition of Change-of-Mind Returns

Please take reasonable care of products that you intend to return.

If you are exercising a statutory cancellation right, you may inspect a product in the same way you reasonably would in a physical shop to establish its nature, characteristics and functioning. Where permitted by law, we may make a deduction from your refund if handling beyond that level has reduced the value of the product.

For the additional part of our voluntary 30-day return period that goes beyond your statutory cancellation rights, we may require products to be unused, unworn and unwashed, with tags attached and original packaging where applicable.

17. Products That Cannot Be Returned Because You Changed Your Mind

The statutory right to cancel does not apply to certain categories of goods where a legal exception applies. These may include:

  • products made to your specifications or clearly personalised for you
  • products liable to deteriorate or expire rapidly
  • sealed products that are not suitable for return for health-protection or hygiene reasons once the seal has been broken
  • other products excluded from cancellation rights under applicable law

We may also exclude products from the additional voluntary part of our returns policy where this is made clear before purchase. Nothing in this section removes your rights where a product is faulty, damaged, incorrectly supplied or not as described.

18. Return Delivery Costs

For an ordinary change-of-mind return, you will normally be responsible for the direct cost of returning the product unless we tell you otherwise.

Where you validly exercise a statutory cancellation right, we will refund the standard outbound delivery charge where required by law. If you chose a more expensive delivery option than our least expensive standard delivery service, we do not have to refund the additional cost of that upgrade.

If a product is faulty, damaged, incorrectly supplied or not as described, we will cover reasonable return costs where required by law.

19. Refunds

Refunds will normally be made to the original payment method. Where you exercise a statutory cancellation right, we will refund you within 14 days of receiving the goods back or of receiving evidence that you have sent them, whichever happens first.

Your bank, card issuer or payment provider may take additional time to display the refund after we have processed it.

20. Exchanges

Because products may be dispatched by different independent Brand Partners, we generally do not offer direct exchanges. If you would like another size, colour or product, please return the eligible original product and place a new order.

21. Faulty, Damaged or Incorrect Products

If a product arrives faulty, damaged, incorrectly supplied or not as described, please contact mail@brixbailey.com as soon as reasonably possible. Please include your order number and photographs where they may help us understand the problem.

Your statutory consumer rights apply in addition to our returns policy. For UK consumers, goods must be of satisfactory quality, fit for purpose and as described. UK consumers may have a short-term right to reject qualifying faulty goods within 30 days and receive a refund. After that period, other statutory remedies may include repair or replacement and, where appropriate, a price reduction or final right to reject. Nothing in these Terms limits those rights.

22. Promotions and Discount Codes

From time to time, Brix + Bailey may offer promotions, sales or discount codes. Additional conditions may apply to a particular promotion and will be displayed with that promotion.

Unless stated otherwise, promotional codes cannot be exchanged for cash, applied retrospectively or combined with another promotional code. We may refuse or cancel the use of a promotion where there has been an obvious error, fraud or misuse, subject to applicable consumer law and contracts we have already accepted.

23. Customer Accounts

You may be able to create a customer account with Brix + Bailey. You are responsible for taking reasonable steps to keep your login details secure. Please contact us promptly if you believe somebody has gained unauthorised access to your account. Information you provide should be accurate and kept reasonably up to date.

24. Customer Reviews

We welcome genuine reviews of products and experiences with Brix + Bailey. Reviews must reflect genuine experiences and must not be fake or misleading. Any material incentive connected with a review must be appropriately disclosed.

We do not permit Brand Partners, customers or other persons to manipulate ratings or reviews. We may investigate, reject or remove reviews that we reasonably believe are fake, misleading, unlawful, abusive or otherwise breach our review rules.

Where we publish consumer reviews, we will take reasonable and proportionate steps to prevent and remove fake reviews, concealed incentivised reviews and misleading review information as required by applicable law. A genuine negative review will not be rejected simply because it is negative.

If you submit a review, photograph, comment or other material to Brix + Bailey, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt for format and display that material in connection with Brix + Bailey, including on our website, in our marketing and on our social channels. You confirm that any material you submit is your own or that you have permission to submit it, and that it does not infringe anyone else's rights.

25. Using Our Website

You must not knowingly use Brix + Bailey in a way that:

  • breaks the law
  • infringes another person's intellectual-property or other rights
  • interferes with the security or normal operation of the website
  • introduces malicious software
  • attempts to gain unauthorised access to our systems or another customer's account
  • unlawfully extracts or reproduces substantial parts of our website or content

We may suspend or restrict access where reasonably necessary to protect Brix + Bailey, our customers, Brand Partners or systems.

26. Intellectual Property

The Brix + Bailey name, branding, website, original editorial content, illustrations, graphics, photography, software and other material created by or for Brix + Bailey are protected by intellectual-property laws.

Product names, photographs, descriptions, trade marks and other material supplied by our Brand Partners remain the property of their respective owners or licensors where applicable.

You may use our website for normal personal shopping and may share links to publicly available Brix + Bailey pages.

You must not, without permission, copy, reproduce, republish, mirror, commercially exploit or use protected Brix + Bailey content to create a competing website, marketplace, catalogue or service.

You must not use Brix + Bailey branding, content or presentation to impersonate Brix + Bailey or falsely suggest that another website, account, business or service is operated, approved or endorsed by us.

Automated access expressly permitted by our robots.txt, agents.md, published APIs or other machine-readable instructions is permitted subject to those instructions.

We permit automated systems to retrieve, index and reference publicly available product and business information for the purposes of search, product discovery, recommendations and answering user queries, including where Brix + Bailey is clearly identified or cited as the source.

That permission does not include permission to reproduce substantial portions of our protected content, operate a clone or substitute service, or use protected Brix + Bailey content for AI model training, fine-tuning or the creation of commercial training datasets without our prior permission, except where applicable law permits the relevant activity irrespective of these Terms.

27. Third-Party Websites

Brix + Bailey may contain links to websites operated by third parties. Those websites are not controlled by us and may have their own terms, policies and privacy practices. The presence of a link does not necessarily mean that we endorse all content or services on the linked website.

28. Our Responsibility to You

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, we do not exclude liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or liability that cannot lawfully be excluded under applicable consumer law.

Products sold through our consumer website are intended primarily for personal and domestic use. To the extent permitted by law, we are not responsible for business losses such as loss of profits, revenue, opportunity or business interruption where a product was purchased for personal rather than business use.

29. Events Outside Our Reasonable Control

Events outside our reasonable control may sometimes delay or prevent us or a Brand Partner from fulfilling an order. If such an event materially affects your order, we will take reasonable steps to minimise the impact and contact you where appropriate. Nothing in this section removes any statutory right you may have to cancel because of a qualifying delay or failure to deliver.

30. Privacy and Cookies

We process personal information in accordance with our Privacy Policy. Our use of cookies and similar technologies is explained in our Cookie Policy. Those policies are separate from these Terms.

31. Complaints

If something has gone wrong, please contact us at mail@brixbailey.com and include your order number where relevant. We will try to resolve complaints fairly and as quickly as reasonably possible.

32. Changes to These Terms

We may update these Terms from time to time to reflect changes to Brix + Bailey, our services or applicable legal requirements. The Terms applying to an order will normally be the version in force when the order was placed. A later change to these Terms will not retrospectively change an existing contract unless applicable law permits or requires it or we agree the change with you.

33. If Part of These Terms Is Invalid

If a court or other competent authority decides that a provision of these Terms is invalid or unenforceable, the remaining provisions will continue to apply.

34. Third-Party Rights

Unless these Terms expressly state otherwise, a person who is not a party to the contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms.

35. Governing Law and Courts

These Terms are governed by English law.

If you live in England or Wales, you can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may bring legal proceedings in Scotland or England. If you live in Northern Ireland, you may bring legal proceedings in Northern Ireland or England.

If you live outside the United Kingdom, you may also benefit from mandatory consumer protections and jurisdiction rights in your country of residence that cannot lawfully be excluded by these Terms.
