Welcome to Brix + Bailey

These terms explain the basics of using our website and shopping our marketplace. We've tried to write them in plain English while covering the legal essentials.

Who We Are: Brix + Bailey is operated by Price Heys GmbH, a company registered in Switzerland. We're a family business running a global marketplace that connects conscious consumers with independent brands worldwide.

How Our Marketplace Works

We operate two types of sales:

Brix + Bailey Products: Items we design and make ourselves. When you buy these, your contract is directly with us, and we handle everything from production to customer service.

Partner Brand Products: Items created by the independent brands in our marketplace. When you buy these, your contract is with that specific brand, though we help coordinate the transaction and provide customer service support. We're transparent about which is which - you'll always know who you're buying from at checkout.

Using Our Website

Who Can Use It: You need to be at least 18 or the legal age in your area to make purchases. By using our site, you're confirming you have the legal capacity to make binding agreements.

Account Responsibility: If you create an account, you're responsible for keeping your login information secure and for all activities that happen under your account.

Prohibited Activities: Please don't use our site to do anything illegal, harmful to others, or that could damage our systems or community. This includes things like:

  • Attempting to hack or disrupt our website
  • Creating fake accounts or impersonating others
  • Posting inappropriate or illegal content
  • Using automated tools to collect our data
  • Violating anyone's intellectual property rights

If we believe someone is misusing our site, we may suspend or close their account to protect our community.

Orders and Payments

Placing Orders: When you place an order, you're making an offer to buy. We (or our partner brands) can accept or decline this offer. Your order becomes binding when we confirm it via email or ship your items.

Pricing: All prices are displayed in the currency shown and may change without notice. We do our best to keep prices accurate, but if we discover an error, we'll contact you before processing your order.

Payment: We collect payment when you place your order. We use secure, third-party payment processors and don't store your complete payment information.

Taxes: We'll collect applicable taxes based on your shipping address. For international orders, you may be responsible for additional customs duties or import taxes when your package arrives.

Shipping and Delivery

Delivery Estimates: We provide estimated delivery times, but these aren't guarantees. Shipping times can vary due to factors beyond our control like weather, holidays, or customs processing.

Risk: Once we hand your package to the shipping carrier, it becomes your responsibility. We recommend choosing insured or tracked shipping for valuable items.

International Shipping: For orders crossing borders, you're responsible for any customs duties, import taxes, or restrictions that may apply.

Returns and Refunds

We want you to love what you buy from us. Here's how returns work:

Our Products: Items can be returned within 30 days in original condition with tags attached. Return shipping costs are your responsibility unless the item arrived damaged or defective.

Partner Brand Products: Returns are handled according to each brand's individual policy, which you'll find on the product page. We're happy to help coordinate returns with our partners.

Non-Returnable Items: Some items can't be returned for hygiene or customization reasons - this will be clearly noted before purchase.

Refunds: We process refunds within 5-10 business days after receiving returned items, back to your original payment method.

Defective Items: If something arrives damaged or defective, contact us immediately. We'll make it right either through replacement, repair, or refund.

Warranties and Guarantees

Our Products: We stand behind the quality of items we make and will address any manufacturing defects. Your consumer rights under local law also apply.

Partner Products: Each brand is responsible for their own product warranties. We'll help you connect with brands for warranty claims when needed.

Website: We provide our website "as is" and can't guarantee it will always be available or error-free, though we work hard to keep things running smoothly.

Intellectual Property

Our Content: The design, text, images, and functionality of our website belong to us or our partners. Please don't copy or use them without permission.

Your Content: When you leave reviews or submit other content, you give us permission to display it on our site and use it to improve our services.

Brand Content: Product images and descriptions from our partner brands remain their property.

Privacy and Data

We collect and use your personal information as described in our Privacy Policy. By using our site, you agree to our data practices as outlined there.

Liability and Disputes

Partner Transactions: For products sold by our partner brands, those brands are primarily responsible for product quality, compliance, and customer service, though we're here to help coordinate solutions.

Your Rights as a Consumer

EU/UK Customers: You have specific rights under European consumer protection laws, including withdrawal rights and warranty protections. These rights aren't limited by our terms.

US Customers: You have protection under applicable federal and state consumer laws. If you're in California, you also have specific privacy rights under the CCPA.

Other Locations: You retain all consumer protections provided by your local laws.

Ethical Standards

As a marketplace focused on supporting independent creators, we're committed to ethical business practices. We don't tolerate modern slavery, human trafficking, or other labor abuses in our supply chain. Our partner brands agree to uphold these same standards.

Changes to These Terms

We may update these terms occasionally to reflect changes in our business or legal requirements. We'll notify you of significant changes by email or website notice at least 30 days in advance.

Governing Law and Disputes

These terms are governed by Swiss law, but your local consumer protection laws also apply where they provide additional protections.

Resolving Problems: If you have an issue, please contact us first at mail@brixbailey.com. We're committed to finding fair solutions.

Legal Disputes: If we can't resolve a dispute through discussion, you can pursue legal remedies in your local courts if you're a consumer, or in Swiss courts for business matters.

Force Majeure

Sometimes circumstances beyond anyone's control (like natural disasters, pandemics, or major infrastructure failures) can affect our ability to fulfill orders or provide services. We'll do our best to minimize any impact and keep you informed.
